01Scope and seller
These terms and conditions apply to all orders placed through the BARDH & GENT online shop. The contract is concluded with GSS Analytics Ltd, trading as BARDH & GENT, 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, company number 15429646 (England & Wales) — hereinafter “we”/“us”. Contact: info@gss-analytics.com.
Our offer is directed at consumers in the European Union, Switzerland and the United Kingdom. A consumer is any natural person who concludes a transaction for purposes that are predominantly outside their trade, business or profession.
02Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but an invitation to place an order. By submitting an order you make a binding offer to purchase the selected products. We accept your offer by sending an order confirmation by e-mail or by dispatching the goods, whichever occurs first. The contract language is English.
03Prices and currency
Prices can be displayed in Euro (EUR) or Swiss francs (CHF); the currency selected in the shop applies to your order. All prices include applicable VAT and are quoted exclusive of shipping costs, unless stated otherwise. Shipping costs, where applicable, are shown before you complete your order. For deliveries to Switzerland, import VAT, customs duties and handling fees may be charged by the carrier or customs authorities; these are borne by the customer unless expressly stated otherwise.
04Payment
The accepted payment methods are displayed during checkout. Invoiced amounts are due for payment immediately upon conclusion of the contract, unless a payment method provides otherwise. We reserve the right to exclude individual payment methods for specific orders.
05Delivery
We deliver within the European Union and to Switzerland. Unless stated otherwise in the product description, goods are dispatched within 2–4 business days of the conclusion of the contract. Shipping within the EU is free of charge for orders above € 250 (or the displayed CHF equivalent). If a product is unavailable due to circumstances beyond our control, we will inform you without delay and refund any payments already made.
06Limited runs
BARDH & GENT products are produced in limited runs (typically 300 pieces per drop). Availability shown in the shop is not guaranteed until an order has been confirmed. We reserve the right to cancel orders and issue a full refund where a run has sold out before the order could be confirmed.
07Right of withdrawal
Consumers have a statutory right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day on which you, or a third party other than the carrier indicated by you, acquires physical possession of the goods. To exercise the right of withdrawal you must inform us (GSS Analytics Ltd trading as BARDH & GENT, 71–75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom, info@gss-analytics.com) of your decision by an unequivocal statement, for example by e-mail or letter. You may use the model withdrawal form below, but this is not obligatory.
If you withdraw from the contract, we shall reimburse all payments received from you, including the costs of standard delivery, without undue delay and no later than 14 days after the day on which we are informed of your decision. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back. You shall bear the direct cost of returning the goods unless stated otherwise. You are only liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
08Voluntary 30-day returns
In addition to your statutory right of withdrawal, we grant a voluntary right of return of 30 days from receipt of the goods. Returned items must be unworn, unwashed and in their original condition with all labels attached. The statutory right of withdrawal and your statutory warranty rights remain unaffected by this voluntary policy. Details are set out in our Shipping & Returns policy.
09Retention of title
The goods remain our property until the purchase price has been paid in full.
10Warranty
Your statutory warranty rights in the event of defective goods apply. Nothing in these terms limits any rights you have under the mandatory consumer protection law of your country of habitual residence.
11Liability
We are liable without limitation for damage resulting from injury to life, body or health, for intent and gross negligence, and under any mandatory statutory liability regime. In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
12Governing law and disputes
These terms and any contract concluded under them are governed by the laws of England and Wales, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, you additionally enjoy the protection of the mandatory provisions of the law of the country in which you habitually reside, and nothing in this clause deprives you of that protection or of the right to bring proceedings before the courts of your country of residence. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
13Severability
Should individual provisions of these terms be or become invalid, the validity of the remaining provisions shall not be affected.
